Terms and Conditions of Use

These terms govern access to and use of RootCoach. By registering and using the platform, the user accepts these terms. If they do not agree, they must refrain from using the service.

RootCoach is a tool for managing classes, groups, students, planning and communication for padel and tennis professionals and clubs, with AI-powered assistance features. During the launch phase, access may be offered free of charge through access codes.

• Provide truthful information and keep it up to date.
• Safeguard their access credentials and not share them.
• Use the platform in accordance with the law and these terms, without fraudulent or harmful purposes.
• Have the necessary consent or legal basis to enter third-party data (for example, student data), especially when they are minors.

When a club or coach enters and manages their students' data through RootCoach, that club or coach is the controller of that data and RootCoach acts as the processor, processing it solely on their behalf and following their instructions, in accordance with Article 28 of the GDPR. In particular, RootCoach:

• Will process the data only to provide the contracted service.
• Will apply appropriate technical and organizational security measures.
• Will not disclose the data to third parties except to the providers necessary for the service or by legal obligation.
• Will assist the client in handling data subjects' rights and will delete or return the data at the end of the relationship, unless there is a legal obligation to retain it.

The client (club or coach) warrants that it has the necessary legal basis for processing its students' data, including, where applicable, the consent of the parents or guardians of minors.

All rights to the platform and its contents belong to RootCoach or its licensors. The user receives only a limited, non-exclusive right to use the service.

RootCoach provides the service "as is" and makes reasonable efforts for its availability and security, without guaranteeing the complete absence of interruptions or errors. RootCoach is not liable for damages arising from the user's misuse of the platform or from the information entered by the user.

RootCoach may modify these terms and the service. Relevant changes will be communicated through the platform. Continued use after the communication implies acceptance of the changes.

These terms are governed by Spanish law and are submitted to the courts and tribunals with jurisdiction under current legislation, respecting, where applicable, the jurisdiction corresponding to consumers.
